Bloomberg noted that Binance relies partly on reverse solicitation, routing some European trading through an Abu Dhabi entity. ESMA states that genuine reverse solicitation is very limited and narrowly framed.
Binance told Bloomberg it was actively working toward becoming MiCA-authorised to provide a consistent service. Coinbase, Kraken, and Bitstamp already hold authorizations covering 30 EEA countries. A regulator could challenge Binance’s interpretation, potentially restricting onboarding or trading.
