RLUSD Charter Status Versus USDC and Tether Regulation

USDC (USDC) Editor: Eugene Serbin

finance.yahoo.com reports that RLUSD holds a NYDFS state trust charter with segregated reserves and a conditionally approved OCC federal charter pending final conditions. USDC already possesses full unconditional OCC federal approval, while Tether operates without a US charter or US resolution authority. RLUSD supply has crossed $2 billion, though a 21-bank consortium stablecoin planned for 2027 threatens to close Ripple's regulatory advantage window.

The NYDFS charter requires segregated reserves and fiduciary duty, ranking holders ahead of ordinary creditors if the issuer fails. The OCC national trust charter brings federal prudential supervision, capital rules, and resolution mechanics. Circle received full OCC approval for USDC on July 10, 2026, and added a NYDFS trust charter three weeks later.

Tether publishes quarterly attestations but lacks US prudential supervision, meaning holders face offshore insolvency law if it fails. RLUSD holds $810 million on the XRP Ledger against $756 million on Ethereum. The OCC must convert the conditional national trust charter into an unconditional one by satisfying capital and governance commitments. Until those conditions are cleared, RLUSD remains a state-regulated stablecoin with a federal charter in progress.
